摘要
经济学的新古典分析方法改变了传统法学的研究范式,但这种新的学科方法由于存在制度上的差异,实际运作存在缺乏统一操作机制的困境。在中国的市场化和法制化的进程中,加强法的经济学分析的本土化研究,建立符合中国特色的法律经济学体系是一个有很大拓展空间的领域。
New classical analytical method in economics has changed the research paradigms of traditional law. However,the new method brings the dilemma in unified manipulating mechanism in practical application due to its differences in system. During the process of market - orientation and Legalization of China,it is a perspective research field in intensifying the research of localization of economic analysis in law and setting up a legal economics system with Chinese characteristics.
