摘要
土地和建筑物是民法上两项最重要的不动产,然而由于二者在物理上具有不可分性,导致在各国法律对土地权利和建筑物权利的处理上采取了不同的作法。由于我国土地所有权的特殊性,我国法律上对二者关系也有不同于世界各国的规定。正确处理不动产交易中土地和建筑物的关系,对于充分实现物的效用,满足和实现不同权利人的利益,具有重要作用。
Land and building are the most important real estate in civil laws. Because they can’t indivisible in physics, the laws of various countries are different on treatment of the right of the building and the land right. Because of the particularity of the land ownership of our country, we have a regulation different from the countries all over the world about the relation between land and building on the law. Dealing with the relation between land and building in the trade of the real estate correctly have important function to fully realize the utility of the thing, satisfy and realize the interests of different obligees
