摘要
我国铁路公益性运输和经营性运输之间的界限是模糊的,铁路内部对公益性运输实行交叉补贴.这对铁路改革的进一步深化发展构成了阻碍。解决铁路公益性运输问题,需要明确政府与铁路企业的权责分界,以法律形式确定铁路公益性运输的范围和认定程序,并解决历史债务问题,进而可在此基础上提出我国铁路公益性运输问题的解决思路和补偿方式。
The public-benefited railway transportation and profitable railway transportation haven't been distinguished in China. The railway sector compensated the public-benefited transportation with its own profit. This is an obstacle to the deepening of railway reform. To solve the problems of public-benefited railway transportation, firstly we should define power and responsibility between government and railway enterprises, specify the scope and cognizance program with the form of law, and resolve the problems of historical debt, based on above measures, then propose the solving thoughts and compensation mode.
