生物安全与我国的生物安全法

Biosafety and Biosafety Law of China

生物安全法是近几年迅速发展的一个环境法分支,也是我国环境法学研究领域的一个新课题。文章对生物安全和生物安全法进行了初步的探讨。认为,生物安全法,本质上是在没有科学明确证据的前提下,为行为主体设定特定条件下的行为模式。我国的生物安全立法工作开展较晚,法律法规体系急待完善。

Biosafety law, as an branch of environmental law, developing rapidly in recent years, is a new issue which is being studied in the study of environment law. This paper attempts a discussion of biosafety and biosafety law, and holds that biosafelty law defines how an individual should behave under particular circumstances even if there is no certain proof that MGOs will do harm to environment and human＇ s health. In China, legislations on biosafety didn＇ t begin until recently and the relevant legal system is in urgent need of improvement.
