摘要
“反垄断不反垄断结构,只反垄断行为”的观点在广度和深度上都存在不足,容易引发误解,进而在反垄断立法和实践中造成不良影响,这在我国《反垄断法(送审稿)》中已经有所体现。反垄断是规制垄断结构的一种安排。反垄断的目的不在于惩罚和压制某些企业,而在于规范和引导所有企业。通过限制垄断结构的垄断行为,反垄断促进了垄断结构和其他企业的效率型行为。
The notion of ＂antitrust but not anti - monopoly structure, or anti - monopoly behavior＂ has its extensively and experimentally deficiencies. It arise misunderstanding easily so that give a bad effect on antitrust legislation and practice. This has already been showed on our Antitrust Law （censorship） . Antitrust is a regulation to restrain monopoly structure. It is aimed to prevent all enterprises from creating, maintaining and enhancing market power, but not punish or suppress some dominant firms. Antitrust promotes monopoly structure as well as enterprises＇ economic efficiency through inhibits monopoly structure.
