对我国《能源法》立法问题的思考

Enacting a New Energy Law for China

制定能源法是促进我国能源战略有效实施、保障国家能源供给安全和经济安全的需要,是完善我国能源立法、保障我国经济社会全面协调可持续发展的客观要求。文章从能源的概念、分类及能源领域的社会关系出发,利用法学基本原理和逻辑分析的方法,探讨了能源法的调整对象和范围;进而探讨了能源法的定位、《能源法》应解决的主要问题、能源法的调整方法和工具,以及能源法框架体系谋篇和构架等能源立法中的重大理论问题。

Setting down a focused Energy Law is not only required to enable the implementation of China's energy strategy and ensure its energy and economic security, but also a must to guarantee comprehensive and sustainable economic and societal development in China. Starting from the social relationships developed around energy, and their classification and areas, the article explores the target and scope of a new Energy Law, its purpose, the problems it needs to address, the methods and instruments to be employed, the energy framework and other major theoretical issues involved in energy legislation by employing basic legal concepts and logicala nalysis.
