摘要
社会发展对劳动关系的调节提出了全新要求,劳动争议处理制度的改革已显示其紧迫性。其制度的取向应使争议处理纳入劳动关系调节体系,其内容应体现当事人意志的作用,其效果应达到息讼目的,其方案的设计又必须考虑到我国的国情,尤其是历史的沿革,具体设想是改现行企业调解机制为行政调解机制,改现行先裁后审制为分类处理制度,并辅之以一整套的配套措施。
The adjustment of existing labor dispute settlement system shouldtake the situation of our country into fully consideration, especiallythe history evolution. The concrete assumption is to transform thecurrent enterprise labor dispute mediation mechanism into the admin-istrative mediation mechanism, and to transform the current 'firstarbitration, then judicial judgment' system into the classified disposalsystem.
