摘要
《劳动合同法(草案)》是自1954年第一次公布宪法草案以来,我国第十三部面向全社会公开征集立法建议和意见的法律草案。起草制定《劳动合同法》主要有两方面的原因。一是劳动关系出现了许多新的形式;二是《劳动法》中有关劳动合同的一些条款已经不能适用。《劳动合同法(草案)》的立法创新主要体现在以下三个方面:对约定“试用期”进行限制;规定用人单位在劳动合同终止时支付经济补偿金;规定用人单位的缔约责任和后合同义务。
Labor Contract Draft is the 13^th draft in China that has collected the legislative propositions and objections from the public since the year 1954 when the Constitution Draft was made public in the first time. There are mainly two reasons for drawing up Labor Contract Law. First of all, many new forms of labor relation have shown up; secondly some of the provisions that are concerned with labor contracts in Labor Law cannot be applied nowadays. The legislative innovation in Labor Contract Draft is expressed as follows: 1) it confines the arranged probationary period; 2) it stipulates that the employing unit should pay for economic compensation when the labor contract terminates; 3) it also stipulates that the employing unit should undertake liabilities for wrongs in concluding a contract and obligations after the termination of contract.
