对当代经济法视野中国家职能的思考

Consideration for state function from the aspect of modern economic law

市场经济与国家管理并不存在天然的互补关系,在一定程度上国家协调能弥补市场经济的不足,但不能完全克服其缺陷。从应然的角度来看,当代经济法视野中的国家职能主要包括宏观性、公共性、外部性、垄断性和公平性等方面。但从实然的角度分析,国家在这些方面的职能都具有局限性。为此必须进行制度创新,加强监督力度,建立竞争机制,引入第三组织,完善民主表达方式,加快信息现代化建设等,从而规避国家职能的局限。

There is no natural complementarity between market economy and state function. Modem state function can compensate the limitation of market economy in a certain extent, but cannot completely overcome the disadvantage of market economy. From the aspect of oughtness, state function mainly contains aspects of macro-scope, commonality, exterior and justice. From the aspect of being,, state function in these aspects has limitation. So, to avoid the limitation of state function, it is necessary to perform constitution reform, to strengthen supervision, to make up mechanism of competition, to introduce the third organization, to perfect expression mode of democracy, to quicken the construction of information modernization,
