人类社会正处在知识经济的崭新时代,世界未来的竞争就是知识产权的竞争。知识产权是一种专有权,它在发挥巨大作用的同时,也给社会造成了一定的负面影响,它不利于知识产品的传播与扩散,加剧了发达国家与发展中国家的差距。知识产权制度既应维护权利人的利益,激发其创造热情,又应对该权利加以必要的、适当的限制,保护社会公众的利益,实现私人利益与社会公众利益间之间的平衡。

The human society is occupying the brand-new time of the knowledge economy. In the future, the world competition will be the intellectual property right competition. The intellectual property right are exclusive right. During displaying its huge function,it also has certain negative influence to the society . It does not favor the dissemination and the proliferation of knowledge product ,intensify the disparity between the developed country and the developing nation. The intellectual property rights system should not only maintain obligee＇s benefit and stimulate their enthusiasm of creation , but also provide the essential and suitable limit to the rights , protect the benefit of the public,and realize benefit balance between the private interest and the public.
