地方城市规划法规的两种模式

The Two Patterns of Local Laws and Regulations for Urban Planning

各国地方规划法规与城市规划的关系可以简单地划分为两种模式,模式一是把城市规划转变成法律,模式二是在立法中确立规划的法律地位。我国目前大部分城市的地方城市规划法规建设尚不具备改革的条件,应在模式二的基础上不断完善,并应以确立实施性规划的法律地位、用法律手段赋予和限制规划部门的权力等为建设重点。

The relationship between local laws and regulations and urban planning in various countries can be simply classified into two patterns.Pattern One is to turn the urban planning into laws and Pattern Two is to establish the legal status of planning in the legislation.The local laws and regulations for urban planning in most cities in China are not ready for reform yet.They should be subject to constant perfection on the basis of Pattern Two, with emphasis given to the establishment of the legal status of pJan implementation,provision and limitation of the right of the planning departments throuoh legal means,etc.
