摘要
以美国1996年颁布的《传播净化法案》(Communication Decency Act,简称CDA)为分析对象,评介其缘起、内容,以及所引起的违宪争议,可以了解美国政府通过法律途径限制网络色情所遭遇到的困境。但美国网络色情的控制模式对我国的网络传播净化仍具有一定的借鉴意义。这种模式可以总结为以技术手段为主导、网络素养教育为基础、政府立法为保障、积极寻求国际合作的“综合管理”模式。
This article analyzed the Communication Decency Act issued in 1996 in the U.S., and discussed its origins, contents and the anti-constitution disputes it caused, then revealed how American government used legal methods to control erotic websites. We can learn from America＇s model for the communication decency in our country. It is a comprehensive management model which takes technique as main methods, takes network morality education as basis, takes governmental legislation as protection and is active in searching for international cooperation.
