秘密侦查由于突出工具理性色彩,易对公民权益造成侵害。在分析秘密侦查特征理论和现实悖论基础上,我们应该从隐蔽性、从属性和程序性三方面对其进行规制,以求切实保障公民的合法权益。
In virtue of tool - logos, the secret investigation is tend to violate rights and interests of citizens. Based on the analyse of the inconsistency of theory and practice of the secret investigation, we should restrict the secret investigation in its secret ,hypotaxis and procedure,in an attempt to guarantee rights and interests of citizens.
