“一证通”:纠防超期羁押长效机制之探索

One Warrant for Whole Proceedings: Long-term Mechanism for Correcting and Preventing Overtime Detainment

“一证通”制度,是以《换押提讯提解证》“一证”代替以往的提讯证、提解证、换押证“三证”,使对被羁押对象的提讯、提解、换押及刑事诉讼程序、各诉讼环节时限均在《换押提讯提解证》中加以体现的工作制度。试行“一证通”制度,对预防超期羁押、维护在押人员合法权益、提高诉讼质量和效率等发挥了积极作用。

The ＂one warrant for whole proceedings＂ is a system that substitutes the ＂one warrant＂ of ＂warrant for custody-transfer, arraignment and escort＂ for former ＂three warrants＂ to embody the limitation of arraignment, escort and custody-transfer of the suspect in custody, and limitation of all phases of the criminal procedure in the ＂warrant for custody-transfer, arraignment and escort＂. The system has been proved in practice to be effective in preventing overtime detainment, protecting rights and interests of the detainee, and improving the quality and efficiency of the procedure.
