Discussion on the Trade Liberalization of Legal Service in CAFTA

律师服务贸易自由化是服务贸易自由化的重要内容之一。在CAFTA内,实现律师服务贸易自由化存在法律壁垒等多重障碍。各国应依照《10+1框架协议》的基本原则,有条件、分步骤地制定有关法律服务市场开放的有效和强有力的承诺计划或规范文件;建立国际性争端解决机构,保障律师服务贸易自由化的进程;扩大各成员国律师交流与合作领域;各成员国内部加快涉外法律服务业务执业培训,自觉适应法律服务市场需要。

Trade liberalization of legal service is an important part of the policies of service trade liberalization. In CAFTA, there are many obstacles in realizing the trade liberalization of legal service, like the law barriers. Based on the Framework Agreement of Sino- ASEAN Overall Economic Cooperation, countries should gradually and systematically formulate effective and forceful pledge pro- grams or standardized files at the market open to legal service; establish organizations to resolve international disputes and ensure the progress of trade liberalization of legal service; extend the exchange and cooperation area of the lawyers of all member countries; expedite the practicing training of the legal service in all member countries, take the initiative to meet the needs of the legal service market.
