摘要
在我国,近几年来随着经济的发展和市场竞争的加剧,侵犯商号权的案件逐渐增多,这主要体现在商号之间的冲突和商号权与商标权的冲突,但最主要的是商号权与商标权的冲突。本文主要从它们之间的冲突及其解决来进行论述。
With the economic development and intensification of marketing competition, the cases of infringing upon business establishment rights are increasing. This phenomenon is mainly embodied in the conflicts between the finns or enterprises and between the business establishment rights and trademark rights, especially the latter. The paper focuses on expounding the conflicts and the solution to them.
