The Value Orientation of Criminal Law and the Society

刑法蕴涵着静态的法律规范和通过动态的法律运行环节而达到的某种秩序或状态的双重含义,前者表明了刑法的价值,后者强调的是刑法的某种价值追求。从对刑法价值已有的研究成果入手,将刑法的价值追求定位于和谐社会具有必然的合理性。刑法的价值在和谐社会的追求中得以统一,刑法的价值追求在和谐社会的追求中得以实现,通过刑法实现和谐社会的途径正是刑法价值追求的体现。

Criminal law has double meanings which contain the static laws and regulations and the order which dynamic operations of law aim to achieve. The former explains the value of criminal law while the latter is the value orientation of criminal law. Based on the current studies of the value of criminal law, the author finds it reasonable to orientate the values of criminal law as a harmonious society since the values of criminal law can be unified, realized and manifested during the process of constructing a harmonious society.
