论西方自由心证制度的理念与基础——兼论我国认证制度的现状和改革方向

Discussion on the thinking and foundation of western free evaluation of evidence——With the status quo and reform direction of chinese attestation rules

文章从自由心证的涵义入手,探讨了自由心证的基本理念和基础,分析了我国学者对自由心证制度的评价。并结合我国的证据规则,指出我国目前的认证制度符合我国的国情,但同时要把建立自由心证制度作为认证制度改革的目标。

The article started with the concept of free evaluation of evidence, then discussed its basic thinking and foundation, and analyzed different opinions on it. Lastly points out that our attestation rules is accorded with the situation of our country, at the same time, it is our goal of reforming attestation rules that setting free evaluation of evidence systems.
