论我国环境侵权救济法律制度的完善

On the Consummation of the Legal System of Environment Tort Remedies in china

我国现行的环境侵权救济法律制度存在很多不完善的地方,在环境形势日益严峻的今天已无法充分实现立法者最初的目的。着重从法理与社会经济的方面阐述对环境侵权救济法律制度进行完善的可行性,从立法与司法实践两方面提出完善建议。

The current legal system of environment tort, remedies in China is incomplete, which can not reach the initial target of legislator. This article, from the perspective of legal pluralism and social economy, elaborates the feasibility of the consummation of the legal system of environment tort remedies and puts forward some suggestions, based on the legislation and legal practice.
