审前程序的独立价值与我国审前程序的重构

The Independent Value of Pretrial Procedure and the Reconstruction of China' Pretrial Procedure

从西方国家司法改革的内容来看,审前程序对于纠纷解决的重要作用日益彰显,而我国民事司法改革中审前程序的重要作用还没有充分体现,特别是对审前程序纠纷解决的独立价值方面重视不足。这主要归因于理论界对审前程序独立价值研究缺乏深入,对相关制度建设也较少论证。本文结合西方国家司法改革中对审前程序的理论探索与实践经验,结合我国审前程序的法律规定,阐释了审前程序独立价值及其重要意义,以及提出了相关制度建设的建议,希望有助于完善我国审前程序,发挥审前程序独立价值及功能,从而为高效、经济解决民事纠纷的司法目标实现有所裨益。

The judicatory reform in western countries reveals that the pretrial procedure is playing an increasingly important role in solving civil dispute. However, in China＇ s judicatory reform, the importance of pretrial procedure has not been shown yet, especially its independent value in solving civil dispute. This phenomenon is mainly duo to the lack of theoretical research into this field and the lack of discussion on the system construction. Absorbing the experience of judicatory reform of pretrial procedure in western countries, and taking the laws of pretrial procedure of our country into consideration, this paper illustrates the significance of pretrial procedure and proposes suggestions to construct the relevant system, aiming to provide reference for solving civil dispute.
