论我国期货犯罪的立法完善

Research on Improvement of Legislation on Futures Crime in China

期货市场在我国的发展已有十多年的历史,在期货市场逐步发展壮大的过程中,各种各样的期货犯罪也沉渣泛起。现行刑法对期货犯罪的规定只是简单地用证券犯罪的条文来套用,致使期货犯罪与证券犯罪不分、期货行政法律法规与刑法之间不协调、期货犯罪分子量刑畸重等弊病的出现,这在一定程度上也削弱了刑法对日益多样的期货犯罪打击力度,因此,我国期货犯罪立法尚需进一步的修改与完善。

The futures markets have a history of more than ten years in China. With the development of the futures markets, all kinds of crimes in respect of futures markets arise. The current provisions of PRC criminal law in relation to futures crimes are simply covered by those of securities crimes, which are fairly tmreasonable. Therefore, it undermines the pursuing of criminal liabilities in respect of the increasing futures crimes by way of criminal law. Accordingly, it is necessary that the legislation with respect to futures crimes should be further amended and perfected.
