摘要
有奖销售作为一种成本低,见效快的促销方式被越来越多的经营者采用,《反不正当竞争法》仅规定了三类不正当有奖销售行为,但目前有奖销售花样不断翻新,对现行法提出了挑战,通过对有奖销售的现状进行了归纳,并分析了其产生原因及危害,为立法提供一定参考。
As a promotion method with low cost and high efficiency, sale with prizes is adopted by more and more operators. Only three kinds of sale with prizes are listed in the "Law of Countering Unfair Competition". However, new forms of sale with prizes mushroom rapidly, which challenge the existing law severely. This article induces the present situation of unfair sale with prizes and analyzes its reasons and harmfulness for the purpose of providing reference for legislation.
