Theory and Practice of Late Qing Dynasty on Prison Reform

监狱改良是清末司法改革的一个重要环节,其目的是改良法理,缓和内外矛盾。监狱改良的主持者在西方资本主义法律文化的影响下,对中国旧有的专制主义的司法狱政制度进行了改革。这次改革取得了相当大的成果,完成了由封建狱制向资本主义狱制的转型,在中国监狱史上有里程碑的意义。

The improtant remedy of the late Qing dynasty for solving its governing crisis was to carry out＂ new policy＂ on prison reform. Under the influence of the wester capitalism law culture, the presiders of the jail reform praticed changes on the rooted absolutism lawsuit and jail system. The reform achieved considerable effect and fulfilled the transformation form feudal jail system to the capitalism jail system, which chiseled a milestone in the jail history of China.
