论中国社会保障法律体系的构建

On the structure of China's social security legal system

社会保障法是调整社会保障关系的法律规范的总称,没有健全的社会保障法律体系,就不可能有健全、完善的社会保障制度。社会保障法律体系是全部社会保障法律规范按照不同的具体保障项目分类组合而形成的一个系统化的有机联系的整体。我国社会保障法体系建设起步较晚,目前仍然处于探讨和逐渐完善阶段。由于所处的理论视角不同,人们构筑社会保障法体系的观点也各不相同。

The social security law is a general name of the legal norm for adjusting the social security relationship. There isn＇t a sound, perfect social security system without a sound social security law system. The legal system of the social security is a systematized organic relative whole formed by all social security legal norms according to different concrete project. The system construction of social security law of our country starts relatively late. So far it has been still at the stage that needs gradual probe and perfect. Because of the different academic visual angles, the view in which people construct the system of social security law has nothing in common with each other.
