论我国海运服务贸易法律制度的发展趋势

On development trend in legal system of Chinese maritime transport service trade

加入WTO将使中国外贸进出口量大幅度增加,但我国现行海运服务贸易法律制度存在对民族海运企业扶植力度不够、法律效力太低且内容上相互冲突等问题,并存在立法真空,不利于外贸发展。应加快相关海运法律制度的完善,进一步强化对国际海运市场的法律规范,加强对国内海运市场的法律保护。

Chinas WTO entry makes import and export trade of China increase a lot but China＇s maritime transportation service trade law system has many problems such as insufficient support of national maritime transportation enterprises, low legal effect and conflicts in its contents and so on and has legislative vacuum which is not helpful to foreign trade development. The related maritime transportation laws should be rapidly completed to further consolidate laws and regulations of international maritime transportation market and to protect domestic maritime transportation market by using laws.
