论妨害作证罪的几个问题

A Tentative Study on the Provision about Article 306 of Criminal Law

妨害作证罪是现行刑法增设的新罪名。理论上及实务中对妨害作证罪尚有诸多问题未取得一致看法,本文对有关妨害作证罪的若干有争议的问题进行探讨,以求共识。

There are different comprehensions about article 306 of Criminal Law in practice. Around people＇s disputes, this paper gives a fine explanation about ＂in criminal proceedings＂ , ＂destroy or forge evidence, help any of the parties destroy or forge evidence, or coerce the witness or entice him into changing his testimony in defiance of the facts or give false testimony＂ and ＂a defender or agent ad litem＂ regulated in article 306 of Criminal Law, in order to understand the legal essence exactly and guide judicial practice properly.
