Dimension of Constitutionalism of Economic Power——From the Aspect of Public Events

在近几年时间里,中国社会发生了“非典”、“禽流感”等一系列公共性事件,这些事件大多涉及到国家经济权力深入到公民基本权利并对经济安全产生重大影响力的问题。在紧急状态和常规状态的不同条件之下,国家经济权力的运行有其不同的表现形态和作用力,国家经济权力对私人产权的侵犯应当在怎样的范围、程度之内和程序设计之下才是合法和适当的,以及经济权力决策中的议价与问责、对于公共产品定价中的国家经济权力行使等问题,都是我们必须将其置于宪政的框架之中予以细致分析和探讨的。

In recent years, a series of public events have taken place in China, such as ＂SARS＂, ＂bird flu＂ and so on. These events have covered the problems of state economic power that bring great impact to the citizen＇ s fundamental rights and national economic security. State economic power has different presentation and function under the conditions of emergency and routine. Under the structure of constitutionalism we will analyze and discuss the problems, such as in what scope, to what extent and in what procedure that is proper and legal for state economic power to infringe the title of the private property, how to negotiate and what responsibility it should bear in decision- making, and how to exercise it in price-fixing of public goods.
