论我国夫妻约定财产制

On Marital Property System in China

夫妻约定财产制是夫妻财产制度的重要内容之一,尽管在国外已有较完善的立法规定,但在我国仍然有待于进一步发展,特别是关于夫妻约定财产的内容、程序、法律效力等问题,现行婚姻法都未有具体的规定。结合我国实际情况,对我国现行夫妻约定财产制进行分析,以期提出一些完善我国夫妻约定财产制的立法建议。

Marital property system is one important part of the spouse property system . Although the prescription of marital property system in foreign legislations is almost perfect, it is still a new -born baby in China ,especially the prescription about the content ,procedure and legal validity of the marital property system . Analyzing and commenting on the valid marital property system in China , this article gives some suggestions on perfecting the marital property system .
