从解释学的角度看,对宪法文本含义的追寻实际上是将宪法文本语境化的过程。对宪法语境化的解释要以宪法文本为基础,关键要充分考虑到政治性因素和社会现实性因素,同时要以宪法基本精神和原则为界限,才能对宪法文本做出合理的、时代性的解释,才能实现宪法之现实功用价值。

With respect to interpretation, the search for the meaning of the Constitution is actually to put the text of the Constitution in the context of discourse. The interpretation is not only based on the text itself, but also related to political factors and real social factors, all restricted by the fundamental spirit and principle of the Constitution. Only by doing so can we interpret the Constitution reasonably and realistically and realize its real practical value.
