摘要
夫妻关系存续期间扶养义务应包含救助生命危险。配偶一方自杀时,另一方不加以救助的行为应以遗弃罪追究责任。参照国外刑法关于遗弃罪的有关规定,浅析我国遗弃罪犯罪构成重构的必要性及意义。
The fostering obligation during the marital relationship ought to include rescuing lives. If one of the spouses commits suicide, the other does not save him（her） , he（she） should be punished by law in the name of the crime of abandon. In the light of certain regulations of foreign criminal laws, the paper analyzes shallowly the significance of the reconstruction of abandon crime in China.
