我国民事诉讼审级制度之重构

On Reconstruction of Trail Grade System of Civil Litigation in Our Country

审级制度应以公正和效益为其基本理念。针对我国民事诉讼审级制度的弊端,应以公正和效益为基础进行改造,建立多元化的审级制度。以有限的一审终审制和三审终审制与一般案件的两审终审制共同构成我国的审级制度。

The basic idea of trail grade system is justice and benefit. In view of the fraud of trail grade system of civil litigation in our country, we should reconstruct it based on justice and benefit, and build diverse trail grade system. The trail grade system in our country should be constituted of the limited system of court of first instance being the final, the limited system of court of third instance being the final, and system of court of second instance being the final on common case.
