传统姓名权制度强调的是其中精神利益的保护,随着社会的发展和市场经济的建立,自然人姓名开始具有更多、更直接的财产利益。从历史发展、社会基础、理论分析等方面分析姓名权商品化制度的确立,具有重要的理论和实现意义。
What the system of the traditional right to name emphasizes is how to safeguards the spiritual interests. With the development of the society and the establishment of Chinese market economy, the civil subject's name has direct property interests. Basing on judicial practice and important theoretics and considering relevant provisions the author analyzed establishing the system of the right to name merchandising.
