通过对我国设立巨额财产来源不明罪的矛盾现状与国外类似立法的比较和司法实践中主要涉及的司法认定、共同犯罪、证明责任等问题的分析,探讨了巨额财产来源不明罪的立法缺陷,建议从行政法的完善、刑法的制裁和道德建设方面的保障等几个方面来构建规范的法律体系。

The author, through discussing the contradictory situation of China unclear source crime of big property, the comparison with foreign relative lawmaking, justice identity, co-crime and proof responsibility in the justice practice, has pointed out the lawmaking dejects of unclear source crime of big property and proposed to establish standard law system through perfection of administrative laws, sanction of criminal laws and moral building.
