我国廉政保证金制度实施的制度环境浅析

The Analysis of Guarantee System for Honest Civil Servants Implemented in Our Country

当前在我国廉政建设过程中,一些地方政府和行政单位仿效香港、新加坡等地区和国家治理腐败的成功做法而推行廉政保证金制度,在我国社会引起了广泛关注的同时也引起了很大的争议。廉政保证金廉政作用机制就是这一制度发生作用的形式,这一机制的发生过程可以分为三个阶段:廉政保证金的形成过程、判断公务员履职是否廉洁的过程和诱导公务员作出选择的过程。分别把我国廉政保证金制度作用机制三个阶段的制度环境与香港、新加坡等地区和国家的进行比较分析,可以看出廉政建设的关键在于制度环境的不断完善。首先建立行政人员的自律机制;其次建立对行政人员有关越轨行为的惩戒机制;再次建立有关的防范机制;最后是建立相应的保障机制。

In the course of constructing a clean government, some local governments and administrative units of our country imitate Hong Kong, Singapore of their successful methods to control corruption and pursue clean government earnest money system, which has caused very great dispute while it has caused extensive concern in China. The clean government earnest money system can be divided into three stages： the formation process of the clean government earnest money ; judging whether the officials are honest or not ; inducing the official to make the choice. Comparing the system environment of three stages with those in Hong Kong, Singapore, we can see that the key point for the establishment or cultivation of clean government lies in the improvement of the system environment： establish administrative personnel~ autonomy mechanism ;establish the disciplinary punishment mechanism for the bahavior going off the course; establish the related guard mechanism; establish the corresponding safeguard mechanism.
