家政服务中介的若干法律兼实务问题探讨

Law and Practice of the Home Service Intermediary

笔者从家政服务中介的涵义界定入手,对家政服务中介的法律资质和家政服务中介运行过程中普遍存在的问题,如劳动者、家政服务中介、雇主三方关系和法律责任的分担等进行分析,结合《劳动合同法(草案)》的相关规定,对家政服务中介的相关问题提出解决建议,并试图从归责原则和保险学角度寻求一套公平合理的责任分担机制。

The author first gives the definition of home service intermediary and then analyzes me legal quanncauon of home servieces intermediary as well as the widespread problems in its operation as laborers, home service intermediary and employers. Then the author puts forward some suggestions with the help of relevant regulations in Labor Contract Law （Draft） and tries to seek for a fair and reasonable responsibility-sharing mechanism from the attribtionprinciples and insurance perspective.
