Interest Measurement in Judgement Explanation under the Market Economy Conditions

利益衡量,是指法官在对当事人双方的利益进行估量后,确认和保护哪一方利益的一种裁判方法。司法作为社会控制的重要工具,通过利益衡量方法对冲突的利益进行确认、评估、限制和保护,以化解社会矛盾,调处社会纠纷,维护社会的和谐与稳定。人民的利益高于一切,是利益衡量的前提和基本出发点,是“司法为民”的基本要求和具体体现。维护社会的和谐与稳定,是利益衡量不可逾越的一条底线,是司法裁判追求法律效果与社会效果统一的根本保障。

Interest assessment is the method for judge to recognize and protecte the interests of magistrate side. Under the conditions o fmarket economy, the diversification of interests leads to the contradictions and conflicts between the main bodies in maket. Justice as an essential tool of social control can resolve social conflicts, social mediating disputes, and maintain social harmony and stability through interest measurement. The interests of the people above everything else＂is the basic premise and the starting point for measuring interests. This paper mainly explaines standards and principles to solve the contradictions and conflicts through the theory of interest measurement in light of the new conditions of market economy.
