村民自治议事程序规则立法新探

New Probes into the Legislation of Discussion Procedural Regulation of Villagers' self-government

村民自治议事制度是村民实行民主选举、民主决策、民主管理、民主监督过程中依次进行的步骤与方式的组合排列。《村民委员会组织法》及其辅助法对村民选举进行较为详细的规则设定。村民自治议事的载体组织形式、议事程序启动机制、表决机制及救济机制是村民议事程序的基本要素。因此,村民自治议事程序规则立法应在上述基本要素的基础上科学合理地规划与设计。

Discussion procedre of villagers＇ self - gevernment is the arrangement of steps and ways of carrying out democratic election ,desicion, administration and supervision. The organization law of villagers committee and the laws relating to it give detailed regulation on villagers＇ democratic election. The basic elements of procdure are as follows： the orgnization form;the starting,determining and remedy mechanism. Therefore, the regulation legislation on discussion procedure should be scientificly designed and planned on the basis of the elements mentioned above.
