窃电取证是处理窃电问题的关键,由于电属于无形财物,对已窃电量的评估与确认,其经济性、合法性有待商榷；取证能否成功,成功后所取证据能否被固定,是寻找窃电和证明、确认窃电的决定性依据。在用电检查中,只有及时合法地查证、取证、认证和固定证据,才能有效保障查证的成功。结合法律依据,对目前有关查证取证窃电的证据提取问题、现场鉴定问题进行研究与分析,以提高用电稽查人员的办案成功率。
