论抽象行政行为的司法监督

On the Judicial Supervision of Abstract Administrative Action

抽象行政行为是具体行政行为的直接依据,然而,理论界对它的法律监督问题研究不够。为了加深对其的研究,在此从司法监督的角度分析对抽象行政行为进行司法监督的理论依据,论述对抽象行政行为进行司法监督的可行性,进而提出对抽象行政行为进行司法监督的对策措施。

The concrete administrative action takes its abstract counterpart as the fundamental basis. Unfortunately, the research on the supervision of abstract administrative action is not sufficient. This paper, from the perspective of judicial supervision, expounds the theoretical foundation, the actual requirement as well as the necessity and possibility of judicial supervision of abstract administrative action. Then the author puts forward the strategy of carrying out the judicial supervision of abstract administrative action
