商业贿赂违法犯罪行为的滋生蔓延,已经成为影响我国社会生活的一大公害。目前,商业贿赂犯罪的概念和内涵,尚没有权威的定论,法网还存在漏洞,造成打击不力。论文对商业贿赂犯罪概念、特征等基本问题进行了研究。为了严密法网对存在的漏洞进行了探讨,并结合《联合国反腐败公约》,提出立法完善及建议。

The spread of commercial bribery crimes, has become a public hazard affecting our social life, Currently, the concept and content of commercial bribery has no authoritative conclusion, and so there are still loopholes in the law, resulting in ineffective crackdown. The authors have studied the concept and basic features of commercial bribery and law loopholes . With the integration of the ＂United Nations Convention against Corruption＂, the authors recommend the perfect legislation and proposal .
