论我国地方立法中的权限冲突

On the Conflicts of Local Legislative Competence in China

地方立法在我国法治进程中扮演着重要角色，但在地方立法实践中存在着权限冲突，表现为地方与中央立法机关之间、地方权力机关与地方政府之间、地方人大与其常委会之间，导致了地方立法存在僭越中央专属立法权、地方立法权限范围模糊、地方立法主体之间立法权限不明、地方权力机关立法主导丧失等问题。在建设法治国家进程中，这些问题需要引起重视并应最终加以解决。

Local legislation plays an important role in the process of our rule of law, but in practice there are competence conflicts, such as between the local and central authorities, local authorities and local governments, the local people＇ s congresses and their standing committees, which leads to local legislation invading the central authority, local legislative competence vague, legislative competence unknown between the local legislative subjects, the loss of the leading local authority and so on. In the process of building the rule of law, which should be taken seriously and should eventually be resolved.
