On the Appearance and Quality of the Prosecutor

作为法律守护人的检察官,既要保护犯罪嫌疑人免于警察的恣意,又要保护被告人免于法官的擅断。因此,检察官的定位应考虑其产生时所担负的历史使命,并立足于其现实职能。检察官的应然品貌应当是面貌慈祥,心怀谦抑,手中握有与其职能相符的武器和工具。检察官应然品性的养成应当从选任、培养和规制等三个方面来进行。
