Preamble of Applied Legal Philosophy: Its Attribute and Methods

作为现代法哲学体系的重要组成部分,部门法哲学是法哲学的延伸。因其自身的法哲学属性,它的反思性研究必须运用法哲学的理论框架,采用法哲学的研究范式和方法,以期消解法哲学与法律学之间的人为障碍,消除法哲学与法律学互相脱节的现象,推动法哲学与法律学的密切结合。在方法论上,部门法哲学可运用语义分析法克服定义方法的局限性,消除学术争论中语义混乱的问题;价值分析法以克服工具主义、技术主义及教条主义造成的弊端;进而以反思方法发现部门法学原理和部门法原则的“前提性”问题,不断创新法学理论,更新法律思维,引导法律实践。

As an important constituent of modern legal philosophy, applied legal philosophy is the extension of philosophy of law. Due to its attributes of legal philosophy, the reflective research in applied legal philosophy must apply the theoretical framework, research paradigm and methods of legal philosophy in order to clear up the barriers between legal philosophy and jurisprudence, eliminate the disjunction between legal philosophy and jurisprudence and promote the close integration of the two. Methodologically, applied legal philosophy can make semantic analysis to overcome the limitation of the defining method, eliminating the semantic confusion caused by academic arguments. Value analysis can also be used to deal with the problems caused by instrumentalism, technologism and dogmatism. In addition, the reflective method could be used to discover the fundamental principles of the applied legal philosophy and some ＂premises＂ questions, constantly having theoretical innovation and renewed ideas to guide the legal practice.
