Research on the System of Attorney’s Procuration in Public Prosecution Cases

随着对被害人保护呼声的日益高涨,公诉案件中的律师代理制度为理论界所重视和关注。该文由公诉案件律师代理的适用情形及制度的必要性入手,进而从律师职业的性质、被害人的人权保护、正义理论三个层面分析了该制度的理论基础,最后对代理律师的权利谱系作了简要的展开。

As cries for protecting victims soar increasingly, the system of attorney＇ s procuration is being paid much more attention by the theoretical circle now, This paper starts with the conditions and necessities of the procuration by the attorney in public prosecution cases, and then it analyzes this system~ rationale from the characters of the legal profession, the protection for victims’ human fights and the theory of justice. In the end it gives a scratch spread of attorneys’ rights pedigree.
