摘要
行政处罚听证程序是正确实施行政处罚的关键。本文在说明了什么是听证以及听证的适用范围后,着重阐述了行政处罚听证程序的原则,即明确告知的原则、有求必听的原则、公开听证的原则、职能分离原则与回避原则、审核听证笔录的原则,以指导行政处罚听证程序的顺畅运行。
Hearing procedure of administrative punishment is the key to the correct practice of administrative punishment. After explaining the definition and application range of hearing, this paper discusses in particular the principles of hearing procedure of administrative punishment, including the principles of telling clearly, hearing every plea, hearing openly, dividing functions and obviation rect the hearing procedure of administrative punishment to ,and examining hearing written records, etc, so as to dibe carried out smoothly.
