电子签名的立法比较研究

Comparative Study of Electronic Signature Legislation

关于电子商务的立法活动在国际上已经形成了一种浪潮。我国的电子签名法也已出台。本文通过比较借鉴有关国家关于电子签名的定义、电子签名认证机构的管制及网络服务提供者的责任三个问题的法律规则与制度,对我国的电子签名立法提出一些建议。

Legislation on e-commerce activities in the international arena has become a wave. Chinese signature law has been promulgated. The adoption of a national law on the definition of electronic signatures, electronic signatures and certification body, and network service providers＇ responsibility can provide some enlightenment for our electronic signature legislation.
