对行政许可缺席默认制的思考

On Administrative Licence System of Tacitly Approving Absence

现代行政朝着法治行政、民主行政、责任行政、服务行政发展,对以近代民主政治为背景而产生的行政程序,提出了现代化和法治化的发展要求。行政许可缺席默认制的出现,解决了行政机关容易存在的工作效率低下的问题,极大地方便行政相对人。但是就该制度的存在是否有瑕疵,笔者认为从行政立法和行政许可的角度看,该制度存在着一定的合理性也存在着问题。

Modem administration is developing in the direction of legal administration, democratie administration, duty administration and sen, ice administration. Administrative procedure based on democratie polities needs modernization and legalization. The appearance of administrative lieenee system of tacitly approving absence can solve the problem of inefficiency of administrative organ. The author thinks the system is reasonable while there are some defects from the view of administrative legislation and administrative lieenee.
