《治安管理处罚法》的颁布实现了从“条例”到“法”的重大转变。《治安管理处罚法》补充完善了治安管理处罚制度,对人民警察依法履行职责进行了规范和监督,无论是在实体上还是在程序上,都较《治安管理处罚条例》做了很大的修改,处罚种类的增加、处罚幅度的提高、处罚程序的完善与规范,对公安机关办理治安案件提出了更高的要求。
