摘要
事业单位是我国独特的一种组织形式,它不仅包括公益类的事业单位,也包括监督管理类和经营类的事业单位。这种独特的单位制度是符合我国历史发展和行政建制的,对其改革不能简单地以西方的非营利组织或公益法人制度解决,更不能以所谓财政负担和人员臃肿为出发点设计相应改革方案。其改革应该基于事业单位法人制度的“事业单位性”和“法人性”进行,前者决定了其与政府和社会的关系,后者决定了其独立性。以法人理论思考事业单位法人制度的改革是其法理所在。
Public service unit (Shiyedanwei) is a special organization in China, not only including commonweal units, but also supervisory and managerial units. The special system couldn' t be reformed in the light of foreign nonprofit organization, and couldn' t be designed reform-project basing on finance burden or personnel overstaffed, for it tallies with Chinese history and administration. It should be reformed in the light of its "shiyedanwei" and "artificial person", the former deciding its footing with government and social, the latter deciding its independency.
