On Corporealizing Intangible Property of the Couple——From the Angle of the Division of Couple's Property When Divorcing

现行《婚姻法》突出了夫妻财产制度的立法地位。现行夫妻财产制所规定的夫妻财产形式以现实的有形财产为主,无形财产被忽略。婚姻关系存续期间一方的牺牲、付出应当作为一种财产形式的可期待利益而存在,在离婚时对其进行量化。夫妻离婚时,知识产权的可期待利益、因夫妻一方作出牺牲而导致的人力资本的变化及其所产生的预期利益应作为夫妻共同财产在夫妻之间进行公平的分割。

The present law of marriage gave prominance to the status of legislation of the Matrimonial Property Regimes. The couple＇s property form regulated by the present Matrimonial Property Regimes is mostly about the corporeal property, while the intangible property is neglected. During the existence of marriage relationship, the sacrifice and paying out of one side should be considered as a kind of expectable interest of property modality, and be gauged in the divorcement. When the couples divoree, the expectable interest of knowledge and property right, the change of human capital caused by one side＇s sacrifice and the pruleptie interest resulting from it should be regarded as the couple＇s common property and divided fairly between the couple.
